User Agreement for cajAPP

1. Description of Service

cajAPP allows registered users to notify their friends of casual gatherings through direct, impersonal messages. Users can create "groups" from their phone contacts and send messages to group members, with each recipient receiving a separate, direct text message. cajAPP aims to make notifications about casual events easy and less personal.

2. Eligibility

By using cajAPP, you affirm that you:

• Are at least 18 years old or the legal age of majority in your jurisdiction;
• Have the legal authority to enter into these Terms.
• Agree to use cajAPP for personal purposes only. cajAPP is designed solely for personal and casual social use and may not be used for any business, marketing, promotional, or spam purposes, including but not limited to sending unsolicited commercial messages or advertisements.

If you do not meet these requirements, you are not permitted to use cajAPP.

3. Account Registration and Security

Account Setup:

To use cajAPP, you must create an account with an email address and password or log in via AppleID, Facebook, or Gmail. You agree to provide accurate and current information during registration and to keep your account information up to date.

Security:

You are responsible for maintaining the confidentiality of your account information and password. cajAPP is not liable for any unauthorized access to your account. Notify us immediately if you suspect any security breaches.

4. Access to Contacts

Permissions:

Upon registration, cajAPP will prompt you for access to your device's contacts to enable group creation and message sending. By granting access, you authorize cajAPP to use your contacts solely for the purpose of selecting recipients for your messages.

Responsibility for Contact Data:

You agree that you have obtained consent from your contacts to send messages through cajAPP. We are not responsible for any claims resulting from your unauthorized use of contacts.

5. Twilio Service Provider

cajAPP partners with Twilio for message delivery. By using cajAPP, you agree that:

• cajAPP will use Twilio's messaging service to deliver texts on your behalf.
• Twilio's privacy and security policies govern the handling of messages once transmitted through Twilio's platform.

6. Privacy and Data Handling

Your privacy is important to us. By using cajAPP, you consent to our collection, use, and disclosure of information as outlined in our Privacy Policy. This includes, but is not limited to:

Data Usage:

Information collected for account creation, contact access, and message sending is used solely to facilitate your experience with cajAPP.

Third-Party Sharing:

We do not share your personal data with third parties except as necessary to provide the Service, such as through Twilio.

7. Prohibited Uses

You agree not to:

• Use cajAPP to send messages without the recipient's consent or to engage in spamming activities;
• Violate any laws, regulations, or third-party rights, including sending harassing, offensive, or deceptive messages;
• Reverse-engineer, modify, or tamper with cajAPP in any unauthorized manner.

8. Termination of Service

cajAPP reserves the right to suspend or terminate access to your account, without notice, for violating these Terms or engaging in unauthorized activity. We reserve the right to discontinue, modify, or restrict access to any part of cajAPP at any time.

9. Limitation of Liability

To the fullest extent permitted by law, cajAPP, its affiliates, officers, employees, or agents are not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use cajAPP, even if we have been advised of the possibility of such damages.

10. Changes to Terms of Service

We may modify these Terms at any time. Changes will be posted to this page, and the "Last Updated" date at the top of these Terms will reflect the date of changes. Continued use of cajAPP constitutes your acceptance of any revised Terms.
